1. Introduction and Acceptance
These Terms of Service (“Terms“) govern your access to and use of the website at https://fotograpfia.ragecoffee.in/ (the “Website“) and the photography courses, enrolment, and related services offered by Academia Fotografia (“Academia Fotografia“, “we“, “us“, or “our“). By accessing the Website, enrolling in a course, or making a purchase, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Website or our Services. These Terms are an electronic record under the Information Technology Act, 2000, and do not require any physical or digital signature.
2. Definitions
- “Course” means any photography programme, module, batch, workshop, or session offered by us, including Basic Foundations, Advanced Optics, and Professional Mastery.
- “Student“, “you“, or “your” means any person who accesses the Website, enrols in a Course, or makes a purchase.
- “Content” means all materials made available through the Website or Courses, including text, images, videos, curricula, presentations, and course notes.
3. Eligibility
To enrol in a Course or make a purchase, you must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872. If you are under 18, you may use our Services and enrol only with the involvement and consent of a parent or lawful guardian, who will be responsible for the enrolment
4. Courses and Enrolment
4.1 Course information
We aim to describe our Courses, durations, schedules, and curricula as accurately as possible. Course details — including dates, batch timings, mentors, location, and curriculum — are indicative and may be updated or changed. We will make reasonable efforts to notify enrolled Students of material changes.
4.2 Enrolment process
You may enrol by selecting a Course, adding it to your cart, and completing checkout, or by contacting us directly. Your enrolment is confirmed only once we have received full payment (or the agreed instalment) and sent you a confirmation.
4.3 Seats and batch
Seats in each batch are limited and offered on a first-come, first-served basis. We reserve the right to reschedule, postpone, merge, or cancel a batch — for example, due to insufficient enrolment, mentor unavailability, or circumstances beyond our control (see Section 12, Force Majeure). In such cases, we will offer you a place in an alternative batch or a refund as set out in Section 6.
5. Pricing and Payment
- All Course fees are listed on the Website in Indian Rupees (■) and are payable in full at the time of enrolment unless we expressly agree to an instalment arrangement.
- Prices are inclusive or exclusive of applicable taxes (such as GST) as indicated at checkout. Where taxes apply, they will be charged in addition to the listed price unless stated otherwise.
- Payments are processed through a third-party payment gateway. By making a payment, you agree to the payment gateway’s terms in addition to these Terms.
- We reserve the right to change Course fees at any time, but changes will not affect enrolments already confirmed.
6. Cancellations, Refunds, and Rescheduling
6.1 Cancellation by you
- If you cancel 21 days or more before the Course start date, you are eligible for a refund of 50% of the fees paid.
- If you cancel fewer than 14 days before the start date, the fee is non-refundable. Once a Course has commenced, fees are generally non-refundable, except at our discretion in exceptional circumstances
6.2 Cancellation or rescheduling by us
If we cancel a Course or batch and cannot offer you a suitable alternative, you will receive a full refund of the fees paid for that Course. If we reschedule a batch, you may transfer to the rescheduled batch or another available batch, or request a refund as above.
6.3 Refund processing
Approved refunds will be processed to the original payment method within 7 business days, subject to processing times of the payment gateway and your bank.
6.4 Transfers
Subject to availability and our approval, you may request to transfer your enrolment to a different batch. Transfer requests should be made in writing to us as early as possible
7. Student Conduct and Obligations
As a Student, you agree to:
• Attend sessions punctually and conduct yourself respectfully towards mentors, staff, and fellow Students.
• Not record, photograph, or live-stream sessions without our prior permission.
• Not engage in any unlawful, disruptive, harassing, or discriminatory behaviour during sessions or on thec Website
•Provide accurate enrolment information and keep it up to date.
•Be responsible for your own equipment and personal belongings during in-person sessions and field trips.
We reserve the right to suspend or remove any Student who breaches these obligations, without refund, where the breach is serious.
8. Intellectual Property
8.1 Our content
All Content provided through the Website and Courses — including curricula, course notes, presentations, images, videos, logos, and the “Academia Fotografia” name and brand — is owned by us or our licensors and is protected by applicable intellectual property laws. It is provided to you solely for your personal, non-commercial learning use. You may not copy, reproduce, distribute, publish, resell, sub-licence, or share our Content with any third party, or use it to create competing courses, without our prior written consent.
8.2 Your work
You retain ownership of the photographs and creative work you produce during the Courses. You grant us a non-exclusive, royalty-free licence to use, reproduce, and display work that you voluntarily submit for review, feedback, or in-class discussion for the purposes of delivering the Course
9. User Submissions
When you submit information through our contact or enquiry forms, or otherwise communicate with us, you confirm that the information is accurate and that you have the right to provide it. We handle such information in accordance with our Privacy Policy.
10. Third-Party Links and Services
The Website may contain links to third-party websites and platforms, including our Instagram page and payment gateways. We are not responsible for the content, policies, or practices of these third parties. Your use of such services is at your own risk and subject to their terms.
11. Disclaimers
• Our Courses are educational. While we are committed to providing high-quality instruction, we do not guarantee any specific outcome, including employment, income, commissions, or professional success arising from completing a Course.
•The Website and Services are provided on an “as is” and “as available” basis. We do not warrant that the Website will be uninterrupted, error-free, or free of harmful components.
• Any third-party tools, software, or equipment referenced in our Courses are subject to their own terms, and we make no warranties regarding them.
12. Force Majeure
We will not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including natural disasters, fire, flood, epidemic or pandemic, government action, civil unrest, strikes, power or internet failures, or venue unavailability.
13. Limitation of Liability
To the maximum extent permitted by applicable law, our total aggregate liability to you arising out of or in connection with the Services or these Terms shall not exceed the total amount of fees you have paid to us for the relevant Course. We shall not be liable for any indirect, incidental, special, or consequential losses, or for loss of profits, data, or goodwill. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
14. Indemnity
You agree to indemnify and hold harmless Academia Fotografia, its founders, mentors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party rights.
15. Suspension and Termination
We may suspend or terminate your access to the Website or a Course if you breach these Terms, fail to pay fees, or engage in conduct that we reasonably consider harmful to other Students, our mentors, or our reputation. On termination, the provisions of these Terms that by their nature should survive (including Sections 8, 11, 13, 14, and 16) will continue to apply.
16. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Subject to the dispute-resolution process below, the courts at Mumbai, India shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms. In the event of any dispute, the parties agree to first attempt to resolve it amicably through good-faith discussions.
If the dispute cannot be resolved within a reasonable period, it may be referred to the appropriate courts as set out above.

We may revise these Terms from time to time. The updated version will be posted on the Website with a revised “Last updated” date and will be effective when posted. Your continued use of the Website or Services after changes are posted constitutes acceptance of the revised Terms.
